A concerted effort by the South African Police Service’s (Saps) Flying Squad yielded positive results following the discovery of a dagga den in the quaint Sea Point suburb, in Cape Town.

Here’s what Cape Town police uncovered in the Sea Point apartment

According to police spokesperson Colonel Andrè Traut, the police were alerted about suspicious activity at an apartment that is situated in Bay Road, Sea Point.

It was believed that a 37-year-old male was cultivating dagga at the apartment. In Traut’s own words, the police “reacted on information and conducted a search at the residence.”

The legality of entering a person’s premises without a valid search warrant is a subject of intense debate in South African criminal law.

According to Scielo South Africa, Section 26 of the Criminal Procedure Act, which makes provisions for the entering of premises for the purpose of obtaining evidence, states:

Section 26 of the Criminal Procedure Act provides for the entering of premises by a police official for the purposes of obtaining evidence.

If a police official who is investigating an offence or alleged offence reasonably suspects that a person who may furnish information with reference to such an offence is on any premises, such a police official may enter such premises without a warrant for the purposes of interrogating such a person and obtaining a statement from him, provided that such a police official shall not enter any private dwelling without the consent of the occupier thereof.

At this time, it is not clear whether a search and seizure warrant was issued to the suspect when his Sea Point apartment was raided by the police. Alas, upon entering the premises, authorities walked into what looked like a bionic jungle.

The suspect was placed under arrest and charged with the illegal cultivation of dagga. The suspect, whose identity has been withheld, is due to appear in court this week.

Traut noted that, at this time, Cape Town police are unable to place a monetary value estimate on the amount of dagga that was seized.
